Collecting waste oil (legaly)
I have been offered waste oil for free from a local pub but they need from me a Duty Of Care note in order for them to be happy to let me take it away.
I want to start producing my own WVO using my WVO Processor.
I have contacted the Environment Agency by both email and telephone in order to find out how to do this, but so far have had no response (PS - note second comment below). I know there are exemptions to the requirement for a waste carriers and waste disposal licenses for small bio-fuels producers, homebrew garden-shed-biodiesel makers, but the EA don’t seem able to tell me about them.

yes its a grey area for sure. as part of the general relaxing of regs around small-scale biodiesel the EA have mentioned storage of waste oil:
If you are not required to hold a PPC Permit, remember that the storage of waste oil is regulated under the Waste Management Licensing regulations. However, we do allow you to treat up to 100 litres of waste cooking oil to produce biodiesel. The waste cooking oil and the biodiesel must be securely stored.

but not collection. mostly, pubs don\’t care about the paperwork. one thing you could consider is to register as a waste carrier with the EA. Its £144 for 3 years, and it\’s pretty much a formality: you apply to EA with the cheque and they sort you out. it\’s a pain but if it legitimizes you in the eyes of convenient oil sources it might well be worth it.

Dear Jon,
Thank you for your email regarding using waste cooking oil to make bio fuel and Duty of Care transfer notes.
Everyone has a Duty of Care to make sure waste is disposed of in the right way. One way we make sure that the duty of care is fulfilled is by enforcing that anyone in England or Wales that wants to carry waste is registered as a waste carrier. This registration will allow us to keep track of who is moving waste and where they are moving it to. The cost of this application is £144 and this will cover you for three years. The period of assessment for registration is approximately 2 - 3 weeks, although the legislation does allow a 2-month assessment period.

The Duty of Care also requires records, called controlled waste transfer notes, to be kept by all those who produce, transport, treat or dispose of waste. The waste must be described in writing and a transfer note must be filled in and signed by both parties involved in the transfer. Copies of the transfer note must be kept for two years and must include the following information:
· a description of the waste including its European Waste Code
· the quantity and the type of container it is in
· the time and date when the waste was transferred
· where the transfer took place
· the names and addresses of both persons involved in the transfer
· certificate number of the registered waste carrier (e.g. ABC/123456).
More than one type of waste can be listed on a waste transfer note, so long as the different waste types and quantities are listed individually. Please find a copy of a waste transfer note attached to this email for your reference.

The production on Bio Diesel from waste cooking oil is a low risk waste management activity, therefore, it is unlikely you will need a full Waste Management Licence.
